Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer products and services to you.

Measurements are approximate unless expressly stated otherwise.
Product packaging, accessories, cases, cloths, labels, and presentation may vary where necessary, provided that the essential nature of the purchased product is not materially changed.
Product images are provided for identification and presentation purposes. Minor variations that do not materially affect the product’s function or essential characteristics are not considered defects.
We reserve the right to correct product information, descriptions, specifications, availability, and pricing errors at any time.

Information provided on the website concerning eyewear, lenses, ultraviolet exposure, eye protection, eye health, or related subjects is provided for general informational and educational purposes only.

Unless expressly identified as prescription eyewear, products sold through the website are not prescription medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Payments are processed by Shopify and authorized third-party payment providers. DAVOUDIE does not directly store complete payment card numbers or card security codes.
An order confirmation does not necessarily constitute final acceptance of an order.
SECTION 6 — ORDERS AND ORDER ACCEPTANCE
We reserve the right to accept, reject, cancel, limit, or investigate an order where reasonably necessary, including when:
• A product is unavailable.
• Payment cannot be authorized or verified.
• Information appears incomplete or inaccurate.
• Fraud, unauthorized activity, resale, abuse, or policy violations are suspected.
• A pricing, inventory, product-description, or technical error has occurred.
• Fulfillment or delivery to the requested location is unavailable.
• The order would violate applicable law or platform requirements.
If we cancel an order after payment has been captured, we will issue a refund to the original payment method, subject to processing times imposed by banks and payment providers.
We may limit quantities purchased per person, household, account, payment method, or order.
Products are offered primarily for personal use unless we approve a separate wholesale or commercial arrangement in writing.
SECTION 7 — SHIPPING, FULFILLMENT, AND DELIVERY
Orders may be processed, fulfilled, or shipped by DAVOUDIE or by third-party suppliers, fulfillment partners, warehouses, and shipping carriers.
Shipping and delivery estimates are estimates only and are not guaranteed delivery dates.
Delivery times may be affected by product availability, order verification, carrier operations, weather, customs, holidays, address issues, and circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address.
We are not responsible for delay, failed delivery, or additional expense caused by an incorrect, incomplete, inaccessible, or outdated address supplied by the customer.
Where tracking is available, tracking details may be sent by email or made available through the customer account.
A package may be considered delivered when the carrier’s tracking records show delivery to the address provided at checkout.
Customers should promptly contact us regarding a package reported as delivered but not received. We may require reasonable information and cooperation for a carrier investigation.

SECTION 8 — RETURNS, REFUNDS, AND CANCELLATIONS
Eligible return requests must be submitted within 14 days after delivery of the last item in the applicable order.
To qualify for a return, an item must be unworn, unused, undamaged, unaltered, and returned with its original tags, accessories, protective materials, and packaging, together with proof of purchase.
A return must be requested and authorized before the item is sent back. Items returned without prior authorization may not be accepted.
Customers are responsible for return shipping costs unless the item received is confirmed to be incorrect, materially defective, or damaged upon delivery.
We do not charge a restocking fee under our standard return rules.
Original shipping charges are not refundable except where required by applicable law or where the return results from our confirmed error.
Approved refunds are issued to the original payment method after the returned item is received and inspected.
Banks and payment providers may require additional time to post a refund.
We may reduce or refuse a refund where permitted by law if an item is returned used, damaged, incomplete, altered, or outside the applicable return period.
Order cancellation is not guaranteed. Once an order enters processing or fulfillment, it may no longer be possible to cancel or change it.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.
SECTION 9 — DAMAGED, DEFECTIVE, OR INCORRECT ITEMS
Customers must inspect products promptly after delivery.
Claims involving an item received damaged, materially defective, or incorrect should be submitted to contact@davoudie.com as soon as reasonably possible and include:
• The order number.
• A description of the issue.
• Clear photographs or video of the product.
• Photographs of the packaging and shipping label where relevant.
We may request additional information reasonably necessary to evaluate the claim.
Where a claim is validated, we may provide an appropriate remedy, such as replacement, repair, return authorization, store credit, or refund, subject to applicable law and product availability.
Normal wear, accidental damage, misuse, improper care, unauthorized alteration, loss, theft, or damage occurring after delivery is not considered a manufacturing defect.
SECTION 10 — PROMOTIONS, DISCOUNTS, AND GIFT CARDS
Promotions and discount codes are subject to their stated conditions, availability, eligibility, and expiration dates.
Unless expressly stated otherwise:
• Only one discount may be used per order.
• Discounts cannot be applied retroactively.
• Discounts have no cash value.
• Discounts may exclude certain products or collections.
• Promotional offers may be changed or withdrawn before an order is accepted.
Gift cards, where offered, are subject to applicable law and any additional conditions displayed at purchase.

SECTION 13 — RELATIONSHIP WITH SHOPIFY
DAVOUDIE is powered by Shopify, which enables us to provide the online store and related services.
Purchases made through the store are transactions between you and DAVOUDIE, not between you and Shopify.
Shopify is not the seller of DAVOUDIE products and is not responsible for product quality, fulfillment, customer service, returns, refunds, injuries, losses, or disputes arising from transactions with DAVOUDIE, except to the extent required by applicable law or Shopify’s own direct obligations.
SECTION 14 — PRIVACY
Our collection, use, retention, and disclosure of personal information are governed by our Privacy Policy.
By using the services, you acknowledge that you have reviewed our Privacy Policy.

SECTION 15 — CUSTOMER CONTENT, REVIEWS, AND FEEDBACK

We are not obligated to publish, preserve, compensate, or respond to submitted feedback.

For claims directly arising from an order, and to the extent permitted by law, DAVOUDIE’s aggregate liability will not exceed the amount actually paid to DAVOUDIE for the product giving rise to the claim.
These limitations do not apply where prohibited by law and do not exclude liability that cannot lawfully be limited, including liability for fraud, intentional misconduct, or personal injury caused by conduct for which exclusion is prohibited.

DAVOUDIE will not be responsible for delay or failure caused by circumstances beyond its reasonable control, including severe weather, natural disaster, fire, epidemic, pandemic, labor disruption, transportation interruption, carrier delay, customs action, governmental action, cyberattack, utility failure, supply interruption, or platform outage.
This section does not remove any refund, delivery, or consumer rights that cannot lawfully be waived.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and other policies displayed on the website, constitute the agreement between you and DAVOUDIE concerning use of the services and purchases from the store.
If a product page or written promotion contains specific terms that conflict with general terms, the more specific terms will control for that product or promotion, except where prohibited by law.
SECTION 27 — GOVERNING LAW AND DISPUTES
These Terms and transactions with DAVOUDIE are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.
Where permitted by law, legal proceedings relating to these Terms shall be brought in a court of competent jurisdiction located in Los Angeles County, California.
Nothing in this section prevents a consumer from exercising non-waivable rights or bringing a claim in another forum where applicable law requires or permits it.
Before filing a formal claim, you and DAVOUDIE agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and describing the issue and requested resolution.

We may update these Terms to reflect changes in our business, services, policies, technology, or legal obligations.
The current version will be posted on the website with an updated “Last updated” date.
Changes apply prospectively from the date posted unless applicable law requires otherwise.
Your continued use of the services after the updated Terms are posted constitutes acceptance of the updated Terms, subject to applicable law.
